"Jeweller" means Annie King Jewellery.

"Client" means the customer engaging the Jeweller.

"Customer Materials" means any gemstones, diamonds, jewellery, precious metals, watches, findings or other items supplied by the Client.

"Project" means the remodelling, redesign, repair, remanufacture, stone resetting, restoration or bespoke creation commissioned by the Client.

Upon receipt of Customer Materials, the Jeweller will record and document the items received, which may include photographs, descriptions, weights and measurements.

The Client acknowledges that such records are intended for identification purposes only and do not constitute a formal valuation or guarantee of authenticity.

All Customer Materials are accepted subject to inspection, testing and assessment.

The Client warrants that they are the legal owner of all Customer Materials supplied to the Jeweller or have full authority from the legal owner to authorise work on those materials.

Any quotation provided before the dismantling, testing or examination of Customer Materials is an estimate only.

Following inspection, dismantling or testing, the Jeweller may identify factors that could not reasonably have been discovered during the initial consultation, including but not limited to:

a) hidden gemstone damage;

b) fractures, chips, abrasions or structural weaknesses;

c) previous repairs;

d) poor-quality workmanship;

e) undisclosed treatments;

f) metal contamination;

g) incorrect metal descriptions;

h) mixed metal construction;

i) unsuitable alloys.

Where such issues are discovered, the Jeweller reserves the right to revise the quotation and project specification accordingly.

No further work requiring additional charges will be undertaken without the Client's approval.

The Jeweller reserves the right to charge a non-refundable assessment fee for the testing, sorting, documentation, photography, weighing and evaluation of Customer Materials. This fee remains payable whether or not the Project proceeds.

The Client acknowledges that the process of removing gemstones from existing settings carries an inherent risk of damage.

Many gemstones contain pre-existing fractures, inclusions, abrasions, chips, cleavages or weaknesses that may not be visible while set.

Existing settings frequently conceal damage that only becomes apparent once stones are removed.

Despite exercising reasonable skill and care, the Jeweller cannot guarantee that gemstones can be removed without damage.

The Client accepts the risk of damage occurring during the removal process where such damage results from pre-existing conditions, hidden weaknesses or the inherent nature of the gemstone.

4.6 The Jeweller shall not be liable for deterioration, chipping, cracking, cleaving or breakage resulting from such pre-existing conditions or inherent vulnerabilities.

The Jeweller is not responsible for confirming the identity, origin, treatment status or value of gemstones unless specifically instructed to do so.

Gem identification, testing, certification or valuation services may incur additional fees.

Where specialist testing is required, the Jeweller may refer gemstones to independent gemmologists or laboratories at the Client's expense.

Any opinions, reports or certifications provided by third-party gemmologists or laboratories remain their responsibility.

The Client acknowledges that certain gemstones and diamonds may have undergone treatments or enhancements that are not disclosed and cannot be identified without specialist testing.

Such treatments may include, but are not limited to, fracture filling, laser drilling, coating, irradiation, dyeing, HPHT treatment and clarity enhancement.

The Jeweller shall not be liable for any alteration, deterioration or damage resulting from the discovery of, or reaction to, such treatments during normal manufacturing, repair, setting, cleaning or finishing processes.

Customer-owned gemstones are reset at the Client's risk.

The Jeweller will exercise reasonable skill and care when handling, setting and finishing Customer-owned gemstones.

The Client acknowledges that older, heavily worn, treated, included, brittle or previously damaged stones carry a higher risk of damage during manufacture and setting.

The Jeweller strongly recommends that valuable gemstones are insured by the Client throughout the duration of the Project.

Unless expressly agreed in writing, the Jeweller shall not be responsible for obtaining insurance for Customer-owned gemstones.

The Jeweller does not guarantee that any supplied gemstone will ultimately be suitable for incorporation into the final design.

All metals supplied by the Client will be tested and assessed before use.

The Client acknowledges that supplied materials may differ from their believed composition, purity or value.

The Jeweller may determine that Customer-supplied metals are unsuitable for reuse due to:

a) contamination;

b) unknown composition;

c) solder content;

d) structural degradation;

e) brittleness;

f) presence of hazardous elements;

g) manufacturing risks.

The Jeweller reserves the right to refuse to reuse any material considered unsuitable.

Where Customer-owned metal cannot be reused, the Jeweller may offer a scrap value credit towards the Project.

The Jeweller does not guarantee that any supplied precious metal will ultimately be suitable for reuse, even where initial discussions suggested otherwise.

The Client acknowledges that refining, melting, alloying, rolling, soldering, filing, polishing, casting and manufacturing processes naturally result in material loss.

The Jeweller does not guarantee that the weight of precious metal recovered from Customer Materials will equal the original weight supplied by the Client.

The Jeweller reserves the right not to melt or reuse materials that may contain hazardous or unsuitable substances including, but not limited to, lead, cadmium, nickel, mercury or unknown alloys.

The decision as to whether any material is suitable for reuse shall rest solely with the Jeweller.

Any replacement metal required for the Project shall be charged separately unless otherwise agreed.

Where requested by the Client, the Jeweller may arrange the sale of Customer-owned precious metals to a bullion dealer, refiner or metal merchant.

The Jeweller acts solely as an intermediary and makes no guarantee regarding market prices achieved.

The Client authorises the Jeweller to instruct refiners, dealers or bullion buyers on their behalf.

An administration fee of £100 may be charged for handling, testing, documenting, photographing, sorting, processing, transporting and administering such transactions.

Sale proceeds may be credited directly against the Project balance unless otherwise agreed.

The Client acknowledges that precious metal prices fluctuate and that final proceeds will depend on weight, purity, refining results and prevailing market conditions.

The Jeweller may engage specialist third parties where necessary, including but not limited to:

a) stone setters;

b) engravers;

c) polishers;

d) lapidaries;

e) gem cutters;

f) assay offices;

g) refiners;

h) laboratories.

Such specialists are selected with reasonable care.

The Client acknowledges that certain specialist services inherently carry risks of damage, loss or alteration.

To the extent permitted by law, the Jeweller's liability for acts or omissions of independent third-party specialists shall be limited to the amount recoverable from that third party.

Where a third party accepts direct responsibility for work undertaken, any claim relating to that work shall first be directed to the relevant third party.

The Jeweller shall take reasonable care of Customer Materials while in its possession.

The Jeweller shall maintain appropriate business insurance as required by law and commercial practice.

The Jeweller's total liability for loss or damage caused by its negligence shall not exceed the replacement value reasonably evidenced by the Client or, where no evidence exists, the fair market value determined by an independent expert.

The Jeweller shall not be liable for sentimental value, emotional value, consequential loss, indirect loss or loss of future appreciation.

Clients are strongly encouraged to maintain their own insurance cover for all Customer Materials.

The Jeweller does not provide insurance for the full replacement value of Customer-owned gemstones or jewellery unless expressly agreed in writing.

Design changes requested after work has commenced may result in additional charges.

Revised completion dates may apply where changes are requested.

The Jeweller reserves the right to modify construction details, technical specifications or manufacturing methods where necessary to ensure the durability, structural integrity, wearability, safety or long-term performance of the finished piece.

Where such modifications materially affect the appearance or specification of the design, the Client will be consulted before work proceeds.

The Jeweller does not guarantee that all requested design concepts are technically achievable using the Client's existing materials.

Where a gemstone requires replacement for any reason, the Jeweller will make reasonable efforts to source a suitable replacement.

The Jeweller cannot guarantee an exact match in colour, clarity, cut, proportions, fluorescence, origin, age or other characteristics.

Finished work must be collected within 60 days of notification of completion unless otherwise agreed.

The Jeweller reserves the right to charge reasonable storage fees after this period.

Where items remain uncollected for more than six months, and reasonable attempts have been made to contact the Client, the Jeweller reserves the right to continue charging storage fees.

Where items remain uncollected for more than twelve months, the Jeweller reserves the right, to the extent permitted by law, to sell the item in order to recover outstanding balances, storage charges and reasonable administrative costs.

Any remaining balance shall be retained for the Client for a reasonable period in accordance with applicable law.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot legally be excluded.

Subject to the clause above the Jeweller's liability shall be limited to losses that are reasonably foreseeable and directly caused by breach of contract or negligence.
